These Terms of Service ("Terms") govern your access to and use of CarGeek mobile application ("App," "Service," "we," "us," or "our"). By downloading, installing, or using CarGeek, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By creating an account or using CarGeek, you represent that you are at least thirteen (13) years of age and have the legal capacity to enter into these Terms. If you are under eighteen (18) years of age, you represent that you have obtained parental or guardian consent to use the App.
2. Description of Service
CarGeek is an educational mobile application focused on automotive knowledge and trivia. The Service provides quiz questions covering topics including vehicle makes and models, brand recognition, automotive specifications, performance statistics, and related automotive facts. The App utilizes publicly accessible data sources to generate quiz content.
3. Account Registration and Security
3.1 Account Creation
To access certain features of the App, you must create an account through Firebase Authentication. You agree to provide accurate, current, and complete information during registration and to update such information as necessary to maintain its accuracy.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Restrictions
You may create only one account per person. Creating multiple accounts to circumvent usage limitations or subscription requirements is strictly prohibited and may result in termination of all associated accounts.
4. Subscription Plans and Pricing
4.1 Free Tier
The free tier includes the following features:
- Thirty (30) fuel with a thirty (30) minute cooldown period per unit of fuel
- No skip functionality for quiz questions
4.2 Premium Tier ($2.99)
The $2.99 subscription tier includes:
- Twenty (20) additional fuel per day beyond the base allocation
- Reduced fuel cooldown period of twenty (20) minutes (30% reduction)
- One (1) skip button per quiz session
4.3 Premium Plus Tier ($4.99)
The $4.99 subscription tier includes:
- Maximum capacity of one hundred (100) fuel per day
- Reduced fuel cooldown period of ten (10) minutes (60% reduction)
- Two (2) question skip buttons per quiz session
4.4 Billing and Renewals
Subscription fees are billed on a recurring monthly basis through your device's app store payment system (Apple App Store or Google Play Store). Subscriptions automatically renew unless cancelled at least twenty-four (24) hours before the end of the current billing period. Subscription management and cancellation must be performed through your device's app store settings.
4.5 Price Changes
We reserve the right to modify subscription pricing at any time. Price changes will not affect active subscriptions until the next renewal period. Continued use of the subscription after a price change constitutes acceptance of the new pricing.
4.6 Refund Policy
All subscription purchases are subject to the refund policies of the respective app store (Apple App Store or Google Play Store). We do not process refunds directly. Subscription fees are non-refundable except as required by applicable law or the policies of your app store provider.
5. Fuel System and Cooldown Mechanics
5.1 Fuel Functionality
Fuel is consumed when you answer a quiz question incorrectly. Fuel regenerates automatically based on the cooldown period associated with your subscription tier. The maximum amount of fuel you can accumulate is determined by your subscription tier.
6. Prohibited Conduct
You agree not to:
- Manipulate device settings, including system time, to circumvent usage limitations
- Use automated systems, scripts, or bots to interact with the App
- Reverse engineer, decompile, or disassemble the App or attempt to extract source code
- Create multiple accounts to circumvent subscription requirements or usage limitations
- Submit false, misleading, or malicious feedback or question suggestions
- Interfere with or disrupt the operation of the App or servers supporting the App
- Attempt to gain unauthorized access to any portion of the App or related systems
- Use the App for any unlawful purpose or in violation of any applicable regulations
- Reproduce, distribute, modify, create derivative works of, publicly display, or exploit any portion of the App without express written permission
7. User-Generated Content
7.1 Question Suggestions
The App allows users to suggest quiz questions for potential inclusion. By submitting a question suggestion, you grant us a perpetual, worldwide, royalty-free, non-exclusive license to use, modify, reproduce, and incorporate your suggestion into the App. You represent that your submission does not infringe any third-party intellectual property rights.
7.2 Error Reports
Users may report perceived errors in quiz questions or answers through the in-app feedback mechanism. We review all error reports but do not guarantee removal or modification of any question. Question accuracy is based on publicly available data sources and may reflect information accurate at the time of question creation.
8. Intellectual Property Rights
8.1 Ownership
The App, including all content, features, functionality, software, designs, text, graphics, and the selection and arrangement thereof, is owned by CarGeek and Torwz LTD and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
8.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App on devices you own or control solely for your personal, non-commercial use. This license does not include the right to copy, modify, distribute, sell, or lease any part of the App.
8.3 Trademarks
CarGeek and associated logos are trademarks of Torwz LTD. The App may display trademarks and brand logos of automotive manufacturers for educational purposes. These marks are the property of their respective owners. Display of such marks does not imply endorsement by or affiliation with the trademark owners.
9. Disclaimers and Limitations of Liability
9.1 Service "As Is"
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
9.2 Content Accuracy
While we strive to provide accurate quiz content, we do not warrant the accuracy, completeness, or reliability of any information presented in the App. Quiz content is derived from publicly available sources and may become outdated. We are not liable for any decisions made based on information obtained from the App.
9.3 Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall CarGeek, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for subscription services in the twelve (12) months preceding the claim, or one hundred pounds (£100), whichever is greater.
10. Indemnification
You agree to indemnify, defend, and hold harmless CarGeek and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any content you submit to the App.
11. Termination
11.1 Termination by You
You may terminate your account at any time by contacting us or deleting the App from your device. Termination does not entitle you to a refund of any subscription fees.
11.2 Termination by Us
We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, abuse of the fuel system, creation of multiple accounts, or conduct that we determine to be harmful to the App or other users.
11.3 Effect of Termination
Upon termination, your right to use the App immediately ceases. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability.
12. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the App or any portion thereof at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App. Features available in premium subscription tiers may change over time, and we do not guarantee the continued availability of any specific feature.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting within the App or on our website. Your continued use of the App after such posting constitutes your acceptance of the modified Terms. Material changes will be communicated through the App or via email to registered users. We encourage you to review these Terms periodically.
14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom without regard to its conflict of law provisions.
15. Third-Party Services
The App integrates with third-party services, including Firebase for authentication and backend services. Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Torwz LTD regarding the use of the App and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.
18. No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Torwz LTD.
